1. Agreement

These Terms and Conditions ("Terms") form a binding agreement between you and IKA Studios, registered at Levent 199, Şişli, Istanbul, Turkey ("we", "us", "our"), covering the Pastel — Adult Coloring Book mobile application, any website we operate for it, and every related service (together, the "Service").

Downloading, opening, or continuing to use Pastel means you accept these Terms. If you do not accept them, do not use the Service. Where you use Pastel on behalf of an organisation, "you" means both you personally and that organisation.

We may cancel your access or terminate this agreement if you breach these Terms.

2. Definitions

App: The Pastel — Adult Coloring Book application on iOS and Android.
Content: Artwork templates, palettes, illustrations, audio, text, and any other material we make available in the App.
User Content: Artwork you complete, images you import, and anything else you create or upload through the App.
Subscription: A recurring paid plan that unlocks premium Content and features.
Store: The Apple App Store or Google Play, through which the App is distributed and payments are processed.
Device: Any internet connected hardware used to access the Service.

3. Licence

We grant you a personal, limited, revocable, non-exclusive, non-transferable licence to install and use Pastel on devices you own or control, for your own non-commercial use, in line with these Terms and the rules of the Store you downloaded it from.

This is a licence, not a sale. All rights we do not expressly grant are reserved.

4. What you may not do

You agree not to, and not to let anyone else:

Sell, rent, lease, sublicense, distribute, host, or otherwise commercially exploit the App or any Content.
Reverse engineer, decompile, disassemble, decrypt, or attempt to derive the source code of any part of the App, except where local law expressly permits it.
Remove, hide, or alter any copyright, trademark, or other proprietary marking.
Circumvent paywalls, entitlement checks, rate limits, or any other technical restriction.
Use automated tools to scrape, harvest, or bulk download Content.
Upload material that is unlawful, infringing, hateful, or that depicts a person in a sexual or intimate manner without their consent.
Use the Service in any way that disrupts it, damages our infrastructure, or interferes with other users.

5. Content and intellectual property

All Content in Pastel, along with the name, logo, interface, and underlying software, belongs to us or to our licensors and is protected by copyright and trademark law.

Coloring pages, palettes, and illustrations may be colored and saved for your personal enjoyment. They may not be resold, redistributed as templates, printed for commercial sale, or used as stock assets.

You keep ownership of your User Content. By creating it in the App you grant us a limited, worldwide, royalty free licence to store, process, and display it strictly for the purpose of operating the Service for you. If you choose to share a piece of your work with us for promotional purposes, we will ask you separately and you can refuse.

6. Subscriptions, trials, and billing

6.1 How billing works. Premium features are sold as auto-renewable subscriptions. Payment is charged to your Store account at confirmation of purchase. Prices, terms, and available plan durations are shown in the App before you buy and may vary by country and currency.

6.2 Automatic renewal. Your subscription renews automatically for the same period unless you turn off auto-renew at least 24 hours before the end of the current period. Your Store account is charged for renewal within 24 hours before the period ends.

6.3 Free trials. Where a free trial is offered, any unused portion is forfeited if you purchase a subscription during the trial. If you do not cancel at least 24 hours before the trial ends, the trial converts automatically into a paid subscription at the price displayed at signup.

6.4 Managing and cancelling. Subscriptions are managed entirely through your Store account, under Subscriptions in your Apple ID or Google Play settings. Deleting the App does not cancel a subscription.

6.5 Price changes. We may change prices. Changes take effect on the next renewal after we notify you through the App or the Store, and you may cancel before the new price applies.

7. Refunds

Purchases are processed by Apple or Google, not by us, and refunds are governed by their policies.

Apple App Store: request a refund at reportaproblem.apple.com.
Google Play: request a refund through the Play Store order history or Google Play support.

If something in the App did not work as it should, write to pastel@ikastudios.net and we will look into it and help where we can, including supporting a refund request with the relevant Store. Statutory withdrawal and consumer rights that apply in your country are not affected by this section.

8. Availability and changes to the Service

We may add, change, suspend, or remove features, Content, or plans at any time, and we may release updates that your device must install for the App to keep working. We aim to keep the Service available but do not guarantee uninterrupted or error free operation. Maintenance, third-party outages, and factors outside our control can interrupt access.

9. Third-party services

The App relies on third-party platforms and SDKs for hosting, analytics, crash reporting, advertising, payments, and notifications, and may link to sites we do not control. We are not responsible for the availability, accuracy, legality, or quality of any third-party service. You use them at your own risk and subject to their own terms and privacy policies.

10. Disclaimer of warranties

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty that the Service will meet your requirements or be uninterrupted, secure, or free from defects.

11. Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profit, data, goodwill, or artwork, arising from your use of or inability to use the Service, even if we were advised such damages were possible.

Where liability cannot be excluded, our total aggregate liability is limited to the greater of the amount you paid us in the twelve months before the event giving rise to the claim, or twenty United States dollars.

Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited. Mandatory consumer rights in your country of residence remain intact.

12. Termination

You may end this agreement at any time by cancelling any subscription and deleting the App.

We may suspend or terminate your access without notice if you breach these Terms, if we are required to by law, or if we discontinue the Service. On termination, your licence ends immediately and you must stop using the App. Sections covering intellectual property, disclaimers, liability, and governing law survive.

13. Changes to these Terms

We may revise these Terms as the Service and the law evolve. The "Last updated" date will change, and material revisions will be signalled in the App or by other reasonable means. Continued use after a revision takes effect means you accept it. If you do not accept it, stop using the Service.

14. Privacy

Our handling of Personal Data is described in the Pastel Privacy Policy, which forms part of this agreement.

15. Apple specific terms

Where you obtained the App from the Apple App Store, the following applies:

This agreement is between you and us, not with Apple. Apple is not responsible for the App or its content.
Apple has no obligation to provide maintenance or support for the App.
If the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation.
We, not Apple, are responsible for product liability claims, claims that the App fails to meet a legal requirement, and claims under consumer protection or similar law.
We, not Apple, are responsible for investigating and resolving any third-party claim that the App infringes intellectual property rights.
You confirm that you are not located in a country subject to a U.S. Government embargo, and that you are not on any U.S. Government list of prohibited or restricted parties.
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

16. Governing law and disputes

These Terms are governed by the laws of the Republic of Turkey, excluding its conflict of law rules. The Istanbul Courts and Enforcement Offices have jurisdiction over any dispute, without prejudice to mandatory consumer protections available to you in your country of residence.

If any provision is found unenforceable, the rest remains in force. Our failure to enforce a provision is not a waiver of it.
